Mandatory Training Regulations

The Deficit Reduction Act of 2005 mandates that all agents representing long-term care partnership policies complete initial and ongoing training programs. In addition, a growing number of states are implementing partnership programs which include mandatory training requirements. Other states have mandated long-term care training without yet implementing a partnership program, according to a training model developed by the National Association of Insurance Commissioners (NAIC).

Ultimately the insurance carrier is responsible for determining whether or not a certain course meets regulatory requirements. If in doubt, check with your carrier before taking a course. We recommend that agents take a course that includes partnership content, even if the state does not yet have a plan in place. Agents licensed in multiple states should carefully evaluate the reciprocity rules of each state; "partial" reciprocity means that a state provides credit for general (NAIC) training taken in another state but also requires state-specific training (see the agent info page for a detailed explanation of reciprocity).

NAIC/DRA States

The following states have enacted mandatory long-term care training since the passage of the Deficit Reduction Act and the NAIC Long-Term Care Model Act in 2006. Click on the state name to view a detailed summary of the state regulations. States that are shaded have not finalized a partnership program, but require long-term care training, in most cases according to the NAIC model. Regulations that are notated "carrier discretion" are handled differently by different ClearCert Member Carriers. Please view the regulations statements for each carrier for further details.

Recent changes have been made for the following states: NJ, GA, NE, AR, MO and WI. Check the individual regulations for each of these states for details.

Iowa - Iowa requires that all long-term care agents in Iowa complete a four-hour course on NAIC content by January 1, 2009, and a three-hour follow-up course every three year CE term afterwards. Iowa offers full reciprocity for agents that complete training in a state with a similar requirement.

Note that initial courses for Iowa listed on the ClearCert course list meet the standard 8-hour length requirement. A course length of less than 8 hours is insufficient to review the entire NAIC content requirement and is also insufficient for obtaining reciprocal credit in the many states that require an 8-hour course completion.

State Explanation of Training Requirement

 

Maryland - Maryland adopted a Regulation on Producer Training Requirements for Long Term Care insurance under COMAR 31.14.01.34. As of September 10, 2007, a producer who sells, solicits, or negotiates long term care insurance must complete a one-time training course consisting of at least 8 hours of long term care education. A four-hour follow-up course must be completed every 24 months following. The deadline for completing the initial course is September 10, 2008.

New producers (not licensed before September 10, 2007) must complete the one-time training program of at least 8 hours, BEFORE selling, soliciting or negotiating any long term care insurance.

The producer may apply the number of course credits of any Maryland approved continuing education Long Term Care courses to their overall continuing education requirements. In other words, if a long term care training program has been approved for 8 hours of continuing education, then the producer may apply the 8 hours to the overall continuing education requirement of 16 credit hours.

Maryland training requirements

 

Maine - Maine formalized the partnership training requirements initially announced in September. Maine has adopted the NAIC training content requirements. Currently licensed agents have until July 1, 2008 to complete the initial 8-hour course and must complete a 4-hour follow-up course every 24 months afterwards. New agents may not represent, negotiate or sell long-term care insurance before completing the course.

Minnesota - Minnesota released mandatory long-term care training regulations in July of 2007. Producers must complete a mandatory training course of at least eight hours before representing long-term care partnership policies; after January 1, 2008, this training is required for the representation of all long-term care policies. A four-hour course must be completed within 24 months of the initial training course, and every 24 months thereafter.

Missouri - The state's partnership program goes into effect on August 1st, 2008. Agents must complete an initial 8-hour training course before representing partnership policies, and a 4-hour follow-up course very two years thereafter. Training must be completed by the date upon which a represented carrier releases a partnership policy.

9/10/2008 - Missouri reciprocity has been changed from "carrier discretion" to "non-residents only," as all ClearCert Members have determined that residents must complete a Missouri approved course.

Nebraska - All long-term care agents are required to complete an initial 8-hour, NAIC model course by August 1, 2008, and a 4-hour follow-up course every two years afterwards. 

10/21/2008 - Nebraska no longer requires that content from the NAIC Long-Term Care 2000 Model Act to be included in courses approved for mandatory long-term care training use.

New Jersey - New Jersey's state plan amendment was approved in February of 2008. All long-term care agents are required to complete an initial 8-hour, NAIC model course by July 1, 2009, and a 4-hour follow-up course every two years afterwards.

10/29/2008 - The New Jersey course requirement has been updated as all ClearCert Members have determined that residents may take an 8-hour NAIC course approved for use in any licensed state.

North Dakota - North Dakota formalized its partnership training program requirements on August 3rd, 2007. An initial 8-hour training course must be completed by July 1, 2008, and a follow-up 4-hour course must be completed every 24 months after that date. Training is required for producers representing partnership policies only.

Ohio - Ohio formalized its long-term care partnership program, including mandatory training requirements, on September 10, 2007. Agents representing long-term care insurance have until September 1, 2008 to complete an initial 8-hour training program. A 4-hour course must be completed every 24 months afterwards. The state assigns approved partnership training courses to an LTC8 or LTC4 category to help agents identify courses that will earn them qualified status. Agents that completed a course before its status was changed to LTC8 must contact the DOI to request that the course completion be changed to the new LTC8 course number.

Resident agents can complete training in another state, but only if the course is approved for Ohio LTC8 or LTC4 CE credits - which essentially means reciprocity is for non-resident licensees only.

State Bulletin 2-2008

 

Oklahoma - Oklahoma has established an effective date for its partnership program of July 14, 2008. Long-term care agents must complete a minimum 8-hour training course on long-term care partnership within one year from that date, or by July 14, 2009. The Oklahoma Insurance Department has clarified that courses must cover the state's Medicaid laws and that all courses must be approved for CE (even though the final regs state that CE is optional). This is because the state does not have a separate approval for partnership course use.

Reciprocity is provided for partnership training completed in another state.

Agents licensed after July 15, 2008 must complete an initial 8-hour course before representing LTC insurance, and a 4-hour course every 24 months thereafter.

Oregon - The deadline for Oregon long-term care agents to complete mandatory training was January 31, 2008, so all long-term care agents in Oregon going forward must have completed an initial 8-hour NAIC content course. A 4-hour follow-up course must be completed each two-year period thereafter.

Pennsylvania - Partnership producers must complete a state-authored one-hour course before representing partnership LTC. Agents must also complete an 8-hour partnership training course by December 31, 2008. ClearCert only approves courses for use in Pennsylvania that include the mandatory state content. A follow-up course of at least 4 hours must be taken every licensing cycle following the completion of the initial course.

Rhode Island - Rhode Island does not yet have a formal partnership program in place, but requires long-term care agents licensed before July 3rd, 2007 to complete an initial course of at least 8 hours in length by July 3rd, 2008 and a follow-up course every two years afterwards of at least 4 hours in length. Agents licensed after July 3rd, 2007 had until January 1, 2008 to complete an initial 8-hour course; agents licensed after January 1, 2008 must complete a course before representing negotiating or selling long-term care insurance. Partnership course content is required.

South Carolina - All South Carolina long-term care producers must complete an initial 8-hour training course by 7/1/2009. A 4-hour follow-up course must be completed within 24 months of the initial training. Reciprocal credit is available for all producers.

South Carolina SB1082 LTC CE

 

South Dakota - South Dakota's regulations are unusual in two respects. First of all, state requires documentation of training in the state's Medicaid program and partnership laws.

Secondly, the state has mandated 8 full hours of training. Although South Dakota recognizes a 50 minute per hour training standard for continuing education credit, for the purposes of long-term care partnership credit the state requires 60 minute hours. In effect, this adds an hour and twenty minutes of training time to the average continuing education classroom course.

Tennessee - Tennessee has annotated Code 56, Chapter 42 and now requires all long-term care producers to complete an initial 8-hour training course before representing long-term care insurance. Those who were already licensed to sell LTCi on May 13, 2008 have until June 30, 2009 to complete the course.

Courses must be approved for use, but CE approval is optional, as is receiving credits for completing the course. Reciprocity is available to non-resident producers who complete another state's similar requirement.

Texas - Texas finalized mandatory training requirements for long-term care producers in conjunction with the state's implementation of a partnership program in the state, which will be effective January 1, 2009.

Producers licensed as of 8/5/2008 must complete an initial 8-hour long-term care course by January 1, 2009 or the date a represented carrier introduces a partnership policy, whichever is later. Producers licensed after the regulations' 8/5/2008 effective date must complete a course by the date on which a represented carrier introduces a partnership policy.

A 4-hour follow-up course must be completed every two-year reporting period after taking the initial course.

Courses must included state-specific content, and both initial and follow-up courses must be approved for this specific training use and also for continuing education credit. However, CE credit must be issued only for the 4-hour course; for the 8-hour initial course it's optional. 

Non-resident producers may receive reciprocal credit for completing an NAIC 8-hour course in their home state, but only if the state is a partnership state. Otherwise the agent must complete a Texas-qualified course.

Virginia - The state of Virginia's mandatory long-term care partnership training became effective 9/1/2007. All agents (resident and non-resident) must complete a two-hour Virginia-specific partnership and state law course approved for CE credit, and must complete six general hours of long-term care training. The requirement can be fulfilled in a single course.

Non-resident licensees in Virginia may receive reciprocal credit for 6 hours of general long-term care training, as long as they received CE credit for it from another state. However, two hours of Virginia's training are state-specific and must be completed by both resident and non-resident licensees. Virginia CE credit must be issued to licensees who complete this course - again, whether resident or non-resident.

State Bulletin 07-03

 

Wisconsin (Updated 9/2/2008) - Wisconsin has filed a State Plan Amendment and is awaiting approval. In the meantime, the state has established mandatory long-term care training requirements for all long-term care producers. All LTC agents must complete an initial 8-hour course by January 1, 2009 and a 4-hour refresher course every licensing period after completing the initial course. The training must include two hours of state law content created by the state, and resident producers must complete a Wisconsin course. NAIC reciprocity is available for non-residents, who must complete two hours of state law content.

9/2/2008 - Wisconsin notified ClearCert that reciprocity is only available to non-residents for NAIC content. Non-resident producers must complete a two-hour Wisconsin state/partnership law course. Resident producers must complete a Wisconsin course. The ClearCert regulations for Wisconsin have been updated as a result.

Producers in the four original long-term care partnership states must complete initial training. In California and Indiana a follow-up course must be completed each licensing term. Course completions in these states are not valid for reciprocal credit in NAIC/DRA states.

California - All long-term care agents in California must complete an 8-hour course on general long-term care concepts. Those representing partnership policies must take an 8-hour classroom course on partnership. An 8-hour follow-up course is required each CE term, and continuing education credits must be earned for all courses. Information on California's program is available on the state web site.

Indiana - The state requires all long-term agents to complete initial 8-hour general long-term care course. Partnership agents must also complete a 7-hour classroom course. CE credits must be earned for the initial training. Indiana requires a 5-hour follow-up course every 2-year CE term beginning with the term following completion of the initial course work.
